Employers need to know the new laws COMMERCE COMMENT with Sue Trueman Upper Hutt business advocacy manager, Hutt Valley Chamber of Commerce. Employers -- are you complying with the new laws? As an employer, are you clear on the changes to the Employ- ment Relations and Holidays Act that came into effect on April 1 this year? Changes include: An option for employees to cash up a maximum of one week of annual leave every year, with the agreement of the employer. An option for employees to transfer a public holiday to another working day if this bet- ter suits both parties. An option for employers to seek proof of sickness or injury from an employee for less than three consecutive days off. An average daily pay formula has been introduced for calculat- ing leave and holiday entitlements for those whose hours of work or pay vary. The treatment of holidays and leave during a mandatory closedown'' or shutdown period (this one came into effect November 2010). The 90-day trial period option for new employees has been extended to all businesses. Changes to personal grievance provisions. Changes that affect union access to workplaces and collec- tive bargaining. The role and powers of labour inspectors have been extended. Employers must now retain a signed copy of each employee's individual employment agree- ment. Most of these changes have requirements that sit around them, so it is important to get the full information about these changes. If you are unsure what these changes mean to you as an employer or an employee, check out the Department of Labour's website dol.govt.nz/er/. This website contains excel- lent information about the changes and what you are required to do. There are a number of publications that you can download which give you the information you need. Examples include minimum employment rights and obligations, and a holidays and leave guide. There are tools available on the website like sample letters, forms and calculators, for example a paid parental leave calculator'' and a fantastic employment agreement buil- der'' tool. At the chamber we have cop- ies of many of the department's publications. If you have any questions give me a call on 5279812 and we can get you the information you need. Business assistance If you want some help with your business, Hutt Valley's business growth manager Grant Marris is available. To find out if you are eligible for some free business assist- ance, funding, or vouchers towards the cost of training, or if you would just like to talk to someone about your business, give us a call here at the Chamber of Commerce.
